BodaBay – Terms and Conditions

Welcome to BodaBay, a ride-hailing platform offering convenient and affordable transportation via BodaBoda (motorbike taxis), TukTuks (Bajaji), and car rides in Zanzibar. These Terms and Conditions govern your access to and use of the BodaBay mobile application and related services (“Services”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the BodaBay platform.
1. Definitions
- “BodaBay”: Refers to the company providing the ride-hailing service via its mobile app.
- “User” or “You”: Refers to any individual who registers, books, or uses BodaBay services.
- “Driver”: Refers to individuals registered with BodaBay to offer transport services using a motorbike, TukTuk, or car.
- “Ride”: Refers to a transportation service requested through the BodaBay app.
- “App”: Refers to the BodaBay mobile application available on Android and iOS.
2. Eligibility
To use BodaBay:
- You must be at least 18 years old.
- You must register using accurate and complete personal information.
- You agree to comply with all applicable local laws and regulations.
3. How the Service Works
- Users request a ride through the BodaBay app.
- The system matches the request with an available Driver.
- Users can choose the mode of transport: BodaBoda, TukTuk, or Car.
- Pricing is displayed before confirmation.
- The Driver picks up the User and completes the trip.
4. User Responsibilities
- Ensure that your contact and payment information is accurate.
- Treat Drivers respectfully and follow safety guidelines.
- Do not use the app for illegal or harmful activities.
- Pay for services promptly upon ride completion.
- Wear a helmet when using BodaBoda rides (helmet provided).
5. Driver Responsibilities
- Hold valid licenses and permits for their vehicle type.
- Comply with all road and traffic laws.
- Maintain their vehicles in good, roadworthy condition.
- Provide helmets for BodaBoda passengers.
- Treat passengers with courtesy and professionalism.
6. Pricing and Payments
- Fares are calculated based on distance, time, and selected ride type.
- Final fare will be displayed at the end of the trip.
- Payments can be made via mobile money, cash, or in-app options (if available).
- BodaBay may apply cancellation fees, surcharges, or promotional discounts.
7. Cancellations
- You may cancel a ride request before it is accepted.
- If you cancel after the Driver has been dispatched or delayed excessively, a cancellation fee may apply.
8. Safety
- All Drivers must follow traffic laws and maintain vehicle safety.
- Users are encouraged to verify Driver identity before boarding.
- In case of an emergency, contact local authorities and report to BodaBay support.
9. Limitation of Liability
BodaBay is a technology platform connecting Users and Drivers. We are not responsible for:
- Actions or negligence of Drivers or Users.
- Delays due to traffic, weather, or unforeseen conditions.
- Lost items during transport.
- Any personal injury or property damage during a ride.
10. Account Suspension or Termination
BodaBay reserves the right to:
- Suspend or terminate accounts violating these Terms.
- Restrict access to the app for misuse, fraud, or illegal activity.
11. Privacy Policy
Your privacy is important to us. BodaBay collects and uses personal information as described in our Privacy Policy. By using the app, you consent to this collection and use.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the app after changes means you accept the updated Terms. You are encouraged to review them periodically.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Zanzibar and the United Republic of Tanzania.
